Hokkori Games — Terms of Service

1. IntroductionThese Terms of Service ("Terms") govern your use of any mobile or PC game, application, website, or related service (collectively, the "Services") published by Nikita Kulev PR Racunarsko programiranje Beograd, operating under the trade name Hokkori Games ("Hokkori Games", "we", "us", or "our").
By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.
2. Changes to These TermsWe may update these Terms from time to time. Updated Terms will be posted on our website, and the "Effective Date" at the top will be revised. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
3. Eligibility and Age RequirementsOur Services are intended for users aged 13 and older. If you are located in the European Economic Area (EEA) or the United Kingdom, our Services are intended for users aged 16 and older, in accordance with applicable data protection regulations.

5. Description of ServicesHokkori Games develops and publishes mobile and PC games distributed through platforms including Google Play, the App Store, Steam, and other digital distribution platforms. Our Services may include gameplay features, in-app purchases, virtual items, subscriptions, advertisements, leaderboards, cloud saves, and related functionality.
6. License to Use the ServicesWe grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our Services for your personal, non-commercial entertainment purposes, subject to these Terms.
You do not acquire any ownership interest in the Services or any content within the Services. All rights not expressly granted to you are reserved by Hokkori Games.
7. User ObligationsBy using our Services, you agree to:

• Use the Services only through means authorized by us and the applicable platform (Google Play, App Store, Steam, etc.).
• Comply with all applicable laws, regulations, and platform terms of service.
• Treat other players with respect and refrain from harassing, threatening, or abusing others.
• Refrain from using offensive, discriminatory, or inappropriate language or content.
• Not engage in cheating, hacking, exploiting bugs, or using unauthorized third-party software to gain an unfair advantage or modify the Services.
• Not reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Services.
• Not transmit viruses, malware, or any other harmful code.
• Not interfere with or disrupt the Services, servers, or networks connected to the Services.
• Not impersonate any person or entity or misrepresent your identity or affiliation.
• Not use the Services for any commercial purpose without our prior written consent.

We reserve the right to suspend or terminate your access to the Services if you violate these obligations.
8. In-App Purchases and Virtual Items 8.1 In-App PurchasesSome of our Games may offer optional in-app purchases, including virtual currency, virtual items, premium features, and subscriptions (collectively, "Virtual Items"). Whether a specific Game offers in-app purchases is indicated on its store page and in our Privacy Policy.
All purchases are processed securely through the applicable platform (Google Play, App Store, Steam, etc.). We do not collect, receive, or store your payment card details.
8.2 Virtual ItemsVirtual Items are licensed to you, not sold. You receive a limited, non-transferable, revocable license to use Virtual Items within the applicable Game. Virtual Items have no real-world monetary value and cannot be exchanged, refunded, or transferred to other users or outside the Game, except where required by applicable law.
We reserve the right to manage, regulate, modify, or remove Virtual Items at any time, with or without notice, and we shall have no liability to you for doing so.
8.3 SubscriptionsSome Games may offer auto-renewing subscriptions. Subscriptions renew automatically unless cancelled through the applicable platform's account settings before the end of the current billing period. You can manage or cancel your subscription in your app store or platform account settings at any time.
8.4 RefundsAll purchases are subject to the refund policies of the applicable platform (Google Play, App Store, Steam, etc.). We recommend reviewing those policies before making a purchase. Upon termination of your account or discontinuation of a Game, unused Virtual Items are forfeited without compensation, except where required by applicable law.
9. AdvertisingOur Games may display advertisements provided by third-party advertising networks. These advertisements may be personalized based on your device's Advertising ID and usage data, as described in our Privacy Policy.
You may opt out of personalized advertising through your device settings. Details on how to do so are provided in our Privacy Policy.
We are not responsible for the content of third-party advertisements or for any products or services advertised.
10. Intellectual PropertyAll content in the Services — including but not limited to games, software, graphics, artwork, animations, audio, music, text, logos, trademarks, and user interface design — is the property of Hokkori Games or its licensors and is protected by applicable intellectual property laws.
You may not use, copy, reproduce, distribute, modify, adapt, create derivative works from, display, or transmit any content from the Services without our prior written consent, except as expressly permitted by these Terms.
The Hokkori Games name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Hokkori Games. You may not use these marks without our prior written permission.
11. User-Generated ContentIf any of our Services allow you to submit, upload, or share content ("User Content"), you retain ownership of your User Content but grant Hokkori Games a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, distribute, display, and perform your User Content in connection with the Services.
You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not infringe the rights of any third party.
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.
12. Account Suspension and TerminationWe may limit, suspend, or terminate your access to the Services at any time, without prior notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or if we discontinue the Services.
You may stop using the Services at any time by uninstalling the applicable Game from your device.
Upon termination, your license to use the Services is revoked, and any Virtual Items associated with your account are forfeited without compensation, except where required by applicable law.
13. Disclaimer of WarrantiesTHE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
14. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOKKORI GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR TEN (10) EUROS, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
15. IndemnificationYou agree to indemnify, defend, and hold harmless Hokkori Games and its owner, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
16. Third-Party Platforms and ServicesOur Games are distributed through third-party platforms such as Google Play, the App Store, and Steam. Your use of those platforms is subject to their respective terms of service and privacy policies, which are separate from these Terms.
We are not responsible for the practices, content, or policies of any third-party platform or service.
17. Governing Law and Dispute ResolutionThese Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of laws provisions.
Any dispute arising out of or in connection with these Terms or your use of the Services shall be resolved through good-faith negotiations. If the dispute cannot be resolved amicably within thirty (30) days, either party may submit the dispute to the competent courts of the Republic of Serbia.
18. SeverabilityIf any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
19. Entire AgreementThese Terms, together with our Privacy Policy, constitute the entire agreement between you and Hokkori Games regarding your use of the Services and supersede all prior agreements and understandings.
